Be aware of HOA requirements

If you are among the many Michigan residents who enjoy the convenience of living in a master-planned community, chances are, you have a homeowner’s association. The entity’s goal is to uphold community covenants, maintain common areas and keep the peace between neighbors. It also enforces the maintenance of private property within its boundaries. At Pentiuk, Couvreur & Kobiljak, P.C., we often assist HOAs in protecting community interests.

Bankrate, LLC reports that homeowners who have never lived in a formally created community may not be aware of the association bylaws that may affect them. Checking the requirements of the HOA can help you avoid violating rules that can result in liens and costly fines.

Trash receptacles  Although functional, garbage can invite pests and make the neighborhood less attractive. As a result, most HOAs have guidelines addressing their placement. Confirm how long they can stay street side and whether there are rules about how early they can be set out.

Landscaping  Details such as an overgrown lawn, weeds and a general unkempt look can result in the homeowner association taking action. Check the bylaws and see what type of yard care requirements you have. They may also have specific guidelines regarding what kinds of shrubs, plants and trees you can and cannot plant in the front yard.

Vehicles  HOAs typically have rules governing how many caryou can park on the property and if they can remain on the street overnight. If you have vendors working on your home, they may need to complete work by a specific time or get a special permit for display in their windshield.

Pets, decorations and visible property changes, such as painting your home, adding a shed or planting trees may require permission. Failure to follow bylaws could result in legal action. Visit our webpage for more information on this topic.
